1. How do I know if I’m eligible to participate in the settlement?
You may be eligible to participate in the settlement if you are a woman who applied for a sales or warehouse job at one of American Freight’s stores between July 8, 2013 and December 31, 2021, you were qualified for such employment, and you were not hired.
2. Which of American Freight’s facilities does this settlement apply to?
The settlement applies to all facilities nationwide owned by American Freight, LLC.
3. What am I entitled to as part of this settlement?
If you are found to be an eligible participant in the settlement, you may be entitled to recover monetary compensation.
4. What do I need to do to be considered eligible to participate in the settlement?
The deadline to submit the Questionnaire to be considered eligible to participate in the settlement has passed.
5. When will I be informed if I am included in this settlement?
Upon receipt of your completed Questionnaire, you will be informed within approximately 120 days whether you are eligible for monetary compensation as part of the settlement or not. You will also be provided with a Release of Claims.
6. What do I need to do to be included in the settlement if I am determined to be eligible?
If you are informed that you are eligible to be included in the settlement, you will be provided with a Release of Claims. You must execute and cause the Release of Claims to be received by the Claims Administrator within 45 days after you are informed that you are eligible to be included in the settlement. You may execute the Release of Claims electronically or return a hard copy by mail to EEOC v. American Freight Management Company, P.O. Box 25069, Santa Ana, CA 92799.
7. What will happen if I don’t submit the Questionnaire?
If you do not submit a timely and valid Questionnaire, you will not be eligible for inclusion in this settlement and will not be eligible to recover monetary compensation.
8. What will happen if I don’t execute and return the Release of Claims?
If you do not timely execute and return the Release of Claims, you will not be eligible to be included in the settlement and will not be eligible to recover monetary compensation.
9. Can I still apply for a job with American Freight if I am found to be an eligible claimant?
If you are found to be an eligible claimant, you will have the opportunity to be considered for preferential hiring with American Freight if you are qualified for an available position.
10. Can I be excluded from this settlement?
Yes, if you choose to not be considered as a potential eligible claimant, you may elect not to submit a timely and completed Questionnaire. Even if you are determined to be an eligible claimant, you will be excluded from the settlement if you do not timely execute and return a Release of Claims form.
